The\u00a0Madras High Court\u00a0has said that those occupying temple properties without valid lease deed are to be treated as encroachers.<\/p>\n
Observing that the\u00a0executive\u00a0officer (EO) of a temple in\u00a0Tirunelveli\u00a0had acted in a manner “unbecoming of a public servant,” Justice S M Subramaniam in a recent order directed the\u00a0Hindu Religious and Charitable Endowments Department\u00a0(HR&CE) to oversee the activities of\u00a0executive\u00a0officers (EOs) in all shrines.<\/p>\n
The\u00a0judge\u00a0made the observation while dismissing petitions filed by A Shahul Hameed and A Abdul Kareem challenging the\u00a0eviction\u00a0orders passed by the\u00a0Tirunelveli\u00a0joint commissioner and confirmed by the\u00a0HR&CE commissioner.<\/p>\n
“The very object and purpose of the HR&CE Act is to ensure that every lease and license granted in respect of the temple properties must be direct and the competent authorities alone have to execute such lease deeds or grant permission or lease.<\/p>\n
